Supreme Court Dismisses Pleas Seeking To Enact Religion, Gender-Neutral Uniform Laws | India News


New Delhi: The Supreme Court on Wednesday refused to entertain pleas in search of a route to the Centre to border faith and gender-neutral uniform legal guidelines governing topics like marriage, divorce, inheritance, and alimony, saying it can’t direct Parliament to “enact the law”.

A bench comprising Chief Justice D Y Chandrachud and justices P S Narasimha and J B Pardiwala took word of the submissions of Solicitor General that the problem fell beneath the area of the legislature and therefore the pleas can’t be entertained.

“This issue exclusively falls under the domain of the legislature and a writ of mandamus cannot be issued to Parliament (to enact laws),” mentioned the bench whereas disposing of pleas together with the PILs filed by lawyer Ashwini Upadhyay.

The bench was listening to petitions in search of route to the federal government for enacting uniform faith and gender-neutral legal guidelines on all kinds of points.

Upadhyay had filed 5 separate petitions in search of route to the Centre to border faith and gender-neutral uniform legal guidelines for divorce, adoption, guardianship, succession, inheritance, upkeep, marriage age, and alimony.
