Plea Filed by A Gurugram Resident
The court docket was listening to a plea filed by a Gurugram resident, which claimed Zomato was partaking within the “false and fraudulent” observe of delivering contemporary meals from properly-recognized eating places beneath its sub-class, ‘Dilli ke Legends’.
In an order handed not too long ago, Civil Judge Umesh Kumar stated, “Issue summons of the suit and notice of application.”
According to the plea, Sourav Mall positioned an order on October 24 final 12 months, from three totally different eateries in Jama Masjid, Kailash Colony and Jangpura, following which he tracked the supply associate and located that the order was picked from the “unknown and unnamed” place and never from the unique restaurant.
Key Concerns
The plea stated, “Why was the food picked up from a nearby location when there is no branch of the restaurant partner there? Why is the food not delivered in the original packaging of the restaurant partner? What is the guarantee that the food has been prepared by the restaurant partner? What is the guarantee that the food is prepared fresh and hot?”
It was “inexplicable” how Zomato managed supply from Delhi’s iconic eating places to places in Gurugram and Noida inside half-hour, it added.
The plea stated, “Such representation to users, customers or patrons of Zomato, is indeed intended to deceive the public at large.”
The plea was filed as a “representative suit” for quite a few affected people beneath the Code of Civil Procedure (CPC).
