Bar Council of India (BCI) on Sunday handed a decision opposing the grant of legal recognition to same-sex marriages. Advocate and chairman of Bar Council of India, Manan Kumar Mishra whereas speaking to ANI mentioned that same-sex marriage is towards the tradition of the nation.
“Considering the socio-religious construction of the nation, we thought it (same-sex marriage) is towards our tradition. Such selections wouldn’t be taken by courts. Such strikes should come from course of of laws,’ mentioned Mishra.
The Supreme Court earlier on Thursday mentioned it might be redefining the “evolving notion of marriage” as the subsequent step after decriminalising consensual gay relationship which implicitly recognised that same-sex individuals might reside in a secure marriage-like relationship.
A five-judge Constitution bench headed by Chief Justice D Y Chandrachud, which heard a batch of petitions looking for legal sanction for same-sex marriage, didn’t agree to the competition that not like heterosexuals same-sex {couples} can’t take correct care of their kids.
The CJI referred to situations of alcohol abuse by heterosexuals in households and the adversarial affect it has on kids. He mentioned he didn’t agree to the submission even on the danger of getting trolled. “Even at the risk of getting trolled, but now this has become the name of the game for the judges to confront. Answers what we say in the court are in the troll and not in the court you know,” the CJI mentioned.
