CCPA Issues 20 Notices to IAS Coaching Institutes for Misleading Ads, Imposes Fines On 8 Entities.

The Central Consumer Protection Authority (CCPA) has issued 20 notices to IAS teaching institutes for deceptive ads and imposed penalties on eight such IAS teaching institutes. The data was given by Union Minister of State for Consumer Affairs, Food & Public Distribution Ashwini Kumar Choubey on Wednesday in a written reply to a question within the Lok Sabha.

“The Department of Consumer Affairs is continuously working for consumer protection and empowerment of consumers by enactment of progressive legislations. With a view to modernise the framework governing the consumer protection in the new era of globalization, technologies, e-commerce markets etc Consumer Protection Act, 1986 was repealed and Consumer Protection Act 2019 was enacted,” the Ministry of Consumer Affairs, Food & Public Distribution mentioned in a press release on Wednesday.

Under the Consumer Protection Act, 2019, deceptive commercial in relation to any services or products is outlined as an commercial, which— (i) falsely describes such services or products; or (ii) provides a false assure to, or is probably going to mislead the customers as to the character, substance, amount or high quality of such services or products; or (iii) conveys an specific or implied illustration which, if made by the producer or vendor or service supplier thereof, would represent an unfair commerce observe; or (iv) intentionally conceals necessary data.

Under the provisions of the Consumer Protection Act, 2019, the Central Consumer Protection Authority (CCPA) has been established w.e.f July 24, 2020, to regulate issues relating to the violation of rights of customers, unfair commerce practices and false or deceptive ads that are prejudicial to the pursuits of public and customers as a category.

The CCPA has notified the Guidelines for Prevention of Misleading Advertisements and Endorsements for Misleading Advertisements, 2022 on June 9, 2022. These pointers inter-alia present for; (a) situations for an commercial to be non-deceptive and legitimate; (b) sure stipulations in respect of bait ads and free declare ads; and, (c) duties of producer, service supplier, advertiser and promoting company.
