Senior advocate Shyam Divan, showing for the IRP, mentioned efforts to revive the corporate and preserve it afloat as a going concern can be hit if the lessors are permitted to cancel the lease deed with regard to plane and engines.

The senior lawyer raised the difficulty of jurisdictional competence of the excessive courtroom within the matter.

“We is not going to entertain. Since the proceedings are pending earlier than the Delhi High Court the place petitions are being argued on a day-to-day foundation, we aren’t entertaining this at the moment stage. Let the jurisdictional points even be addressed earlier than the one choose (of the excessive courtroom),” the bench mentioned.

The IRP has challenged the order of a division bench of the excessive courtroom which had upheld the decision of the one choose bench within the case. On July 5, the one choose bench of the excessive courtroom had allowed Go First’s lessors to examine their plane at the least twice a month and perform upkeep.
