Supreme Court has refused to entertain a plea searching for uniform minimal age of marriage for each women and men. While saying ‘it can quantity to directing Parliament to make a regulation to repair the age,’ the apex court dismissed the plea. The bench on Monday acknowledged that the matter comes below the area of the legislature and refused to take care of it.
SC refused to take care of the problem
A bench comprising Chief Justice D Y Chandrachud and Justices P S Narasimha and J B Pardiwala mentioned the matter fell below the area of the legislature and it’ll not be coping with the problem. The top court referred to its February 20 order by which it had dismissed one other PIL filed by advocate Ashwini Upadhyay searching for equality within the authorized age of marriage for women and men.

The plea, filed by one Shahida Quraishi, had sought to improve the authorized age of marriage for girls to 21 at par with males.
Bench dismissed an analogous plea in Feb
During the listening to, the bench noticed it had dismissed an analogous plea in February. Solicitor General Tushar Mehta, showing for the Centre, objecting to the plea mentioned that deciding the plea shall be akin to legislating as that is within the area of the legislature.
The apex court whereas dismissing that plea mentioned that it had dismissed an analogous plea and thus it is not going to entertain this petition additionally.
“The challenge in these proceedings is to the personal laws on the marriage age of men and women. We have decided a similar case on February 20, 2023… and thus plea stands dismissed,” added the court.
