The Income Tax (IT) division on Monday informed the Supreme Court (SC) it will not take any coercive motion in opposition to Congress for tax demand notices of Rs 3,500 cr in view of Lok Sabha elections.
A bench of Justice B V Nagarathna and Justice Augustine George Masih recorded the assertion of Solicitor General Tushar Mehta, representing the I-T division, that no precipitative motion can be taken within the prevailing circumstances until the ultimate adjudication of the matter.
The bench posted the Congress’ plea in opposition to the tax demand notices for July.
At the outset, Mehta mentioned, “I want to make a statement in this matter. The Congress is a political party and since elections are going on, we are not going to take any coercive action against the party.”
The division is just not commenting on the benefit of the matter and all rights and contentions must be left open, he mentioned.
Senior advocate Abhishek Singhvi, showing for the Congress appreciated the gesture, terming it “gracious”, and mentioned all demand notices have been issued in March and earlier than for various years totalling roughly Rs 3,500 crore.
