Two complaints have been lodged towards the Austrian information safety authority the place the tech giants allegedly violated youngsters’s information safety rights.

Privacy rights organisation NOYB on Tuesday lodged two complaints with Austria’s information safety authority towards tech large Microsoft for allegedly violating youngsters’s information safety rights.

When pupils needed to train their General Data Protection Regulation (GDPR) rights, Microsoft stated faculties have been the “controller” for his or her information.

“However, the schools have no control over the systems,” stated NOYB .

Microsoft, alleged the grievance, is making an attempt to contractually dump most of its authorized duties beneath the GDPR on faculties that present Microsoft 365 Education providers to their pupils or college students.

“This means, for example, that access requests to Microsoft go unanswered – while schools have no realistic way of complying with such requests because they don’t hold the necessary data,” the non-revenue talked about.

Maartje de Graaf, information safety lawyer at NOYB, stated that this take-it-or-go away-it strategy by software program distributors comparable to Microsoft is shifting all GDPR duties to colleges.

“Microsoft holds all the key information about data processing in its software but is pointing the finger at schools when it comes to exercising rights. Schools have no way of complying with the transparency and information obligations,” de Graaf stated.

Microsoft supplies such “vague information” that even a certified lawyer can’t totally perceive how the corporate processes private information in Microsoft 365 Education.

“It is almost impossible for children or their parents to uncover the extent of Microsoft’s data collection,” stated de Graaf.
