Agarwal submitted that international funds got here into the corporate legitimately and in due compliance with the relevant legislation and the offences of felony breach of belief and dishonest below the Indian Penal Code, as alleged, weren’t made out. “The court will have to consider…if there is an abuse of process by the investigating or prosecuting agencies. There is a context to the matter,” he acknowledged.

On Tuesday, senior advocate Kapil Sibal had argued on behalf of the petitioner and mentioned that the case in opposition to it was “completely dishonest”. The allegation within the FIR, registered by the Economic Offences Wing of Delhi Police, is that the corporate, PPK Newsclick Studio Pvt Ltd, obtained FDI to the tune of Rs 9.59 crore from M/s Worldwide Media Holdings LLC USA throughout monetary 12 months 2018-19 in violation of the legislation.

The FIR has alleged the funding was made after vastly overvaluing the shares of the corporate to keep away from the alleged cap of 26 per cent FDI in a digital information web site. It has additional alleged that over 45 per cent of this funding was diverted/siphoned off for the cost of wage/consultancy, hire and different bills, which funds are alleged to have been made for ulterior motives.
